Standard Terms and Conditions

The installation covered by this quote may be eligible to be partially funded by the Energy Efficiency and Conservation Authority (EECA) as shown. This will be subject to the availability of funding at the time that you accept this quote. If you accept this quote, we will confirm the amount of funding to be provided for the installation.

By accepting this quote, you:
• Consent to the Service Provider carrying out the work listed above at the address also listed above.
• Authorise the Service Provider to disclose your personal information to EECA, for the purposes of administering the Warmer Kiwi Home programme funding.
• Will, if requested, allow access to the address set out above to allow EECA to inspect the installation of the heating appliance installed.
• Will, if requested, provide such information as EECA reasonably requires to administer and monitor the programme; and
• Acknowledge that you have read the disclaimer below.


Disclaimer:
The contract for the installation of insulation referred to above is only between you and us. EECA provides no guarantee or warranty in respect of the installation of the heating appliance and is not liable to you or any other person for any loss or damages suffered as a consequence of the installation of the insulation referred to above.

Wi-Fi Add on Units
  1. Wi-Fi modules and connectivity: The connectivity of Wi-Fi modules (if included in the scope of works) shall not constitute a reason to withhold or delay payment if there are any issues with connectivity. It is incumbent on the customer to ensure their Wi-Fi modem or router is compatible and accessible for the technician on the day of installation.
  2. Whereby the technician is unable to connect the Wi-Fi module to the customers equipment/service provider, after their best efforts, the module shall be left in place and connectivity becomes the responsibility of the customer. Alternatively the Wi-Fi module can be removed, and the customers quotation can be amended to reflect this change. Note that the Wi-Fi Control Software may not be compatible with all mobile handsets, and this shall be the responsibility of the customer to ensure they have the correct handset for any heat pump purchased with a Wi-Fi application. After the Wi-Fi equipment has been installed (with the exclusion of any warranty issues with the hardware) the ongoing connectivity of the Wi-Fi set up shall be the responsibility of the customer. 
  3. Energy Smart does not warrant that the Wi-Fi Control Service or the Wi-Fi Control Software will be uninterrupted or error-free, that defects will be corrected or that the site, the Wi-Fi Control Software, or the server that makes it available is free of any virus or other harmful elements. Energy Smart does not warrant or make any representations regarding the correctness, accuracy, reliability, or otherwise of the Wi-Fi Control Software or the Wi-Fi Control Service or the results of its use. Nothing in these Terms and Conditions shall affect any rights you may have under the Consumer Guarantees Act 1993 (New Zealand) if it is applicable.
  4. Subject to applicable law, under no circumstances, including, but not limited to negligence, will Energy Smart be liable for any special or consequential damages that result from the use of, or the inability to use, the Wi-Fi Control Software or the Wi-Fi Control Service.
 
 
The Standard Installation Price
The standard installation includes the installation of the outdoor and indoor units on opposite sides of an external wall, with a maximum pipe length of 5m and maximum trunking length of 3m.

The parameters of a standard installation are as follows:
• Copper pipe work shall be of New Zealand Industry Standard with wall thickness of no less than 0.8 mm.
The installation of the outdoor unit includes the provision of suitably sized paver or other method suitable for flat ground. Installers are to ensure the outdoor unit cannot be damaged or its performance impaired by moisture, vegetation, or dirt. Consideration of flooding should be taken into account and the elevation sized accordingly.
• The indoor unit is to be secured to the wall in such a way as to support the weight and maintain the alignment of the unit over the period of its lifetime (to the manufacturer’s specification).
• It shall include all required penetrations through a timber/brick wall or floor.

Note: Where the EECA best practice guide, Electricity (Safety) Regulations 2010 and AS/NZS3000:2018 and any other applicable regulations and standards allow, wiring to a local circuit is acceptable.



Condensate Pumps
The Condensate Pump provided by EnergySmart comes with a 12-month warranty. This warranty covers all Condensate Pump parts with material or manufacturing faults. The Condensate Pump is warranted against defective materials and workmanship for a period of 12- months. Any product that should fail and is still within the warranty period, will be repaired or replaced by EnergySmart. The Condensate Pump warranty is not connected to the Heat Pump Warranty. The Condensate Pump is an optional extra required to accommodate the installation of an air conditioning unit on an internal wall. The Condensate Pump is not covered by any warranty that is offered by the manufacturer of any Air Conditioning Unit or Heat Pump Unit that requires the use of this pump. A condensate pump fault may result in water leaking from the pump. Neither seller nor the manufacturer shall be liable for any damage, loss or injury, direct, incidental or consequential (including , but not limited to incidental or consequential damages for lost profits, lost sales, injury to person or property, or any other incidental or consequential loss), arising out of the use or the inability to use the product and the user agrees that no other remedy shall be available to it.
 
DISCLAIMER: The foregoing warranty is an exclusive warranty in lieu of any other express warranties. Any implied warranties (including , but not limited to any implied warranty of merchantability or fitness for a particular purpose) to the extent either applies to a pump shall be limited in duration to the periods of the express warranties given above. Warranty will be VOID if any of the following conditions are found: 1. Condensate Pump has been damaged post installation. 2. Condensate Pump has been modified or relocated in any way since installation. 3. Alterations to the property where the Condensate Pump has been installed have negatively affected the operation of the pump. 4. Any type of product abuse by customer. Any oral statements about the product made by the seller, the manufacturer, the representatives or any other parties, do not constitute warranties, shall not be relied upon by the user and are not part of the contract for sale. Seller ‘s and manufacturer ‘s only obligation, and buyer’s only remedy, shall be the replacement and/ or repair by the supplier/manufacturer of the product as described above.
